PORTLAND, Ore. (WSET) — A 51-year-old charged with animal abuse and sexually assaulting an animal has been sentenced to 60 days in jail, three years probation on each charge and may not possess a dog for 15 years.
The Oregonian reported that Fidel Lopez got the maximum penalty after he pleaded guilty to first-degree aggravated animal abuse and sexual assault of an animal on his Lhasa Apso mix, Estrella.
He was released the same day after getting credit for time served.
"If it could have been more, I would have gladly given you more," the judge said in court.
In court Monday, prosecutors said his fiance found their dog bleeding, whining, and hiding under a couch in November. The dog was taken to the vet, where Estrella had to be euthanized due to the injuries.
Prosecutors said veterinarians performed an animal sexual assault forensic evaluation, which confirmed Estrella had been sexually assaulted.
A DNA test proved that Lopez was involved in the sexual assault.
During the investigation, he admitted to sexually abusing the dog.
As part of his probation, Lopez can't contact Estrella's owner without prior permission from the probation department. He must undergo an assessment and complete any treatment for adults who abuse animals and undergo separate evaluations for drug and alcohol and domestic violence and complete treatment if ordered. He was also ordered to pay $500 in restitution.
While on probation, he may not own or care for any type of animal.
