I've been making payments for OUR car for almost three years, but it's in my mother-in-law's name. My wife and I and our son are moving overseas for a new job and want to sell our car. The mother-in-law says she will not let us, although we can make $4000 by selling it to Carmax. She still will not let us. She says we should just consider it "renting". This is not what was agreed upon when buying the car. Can we sue her for the $10,000 that we've paid for the car over the past 3 years if we have proof of payment for all of it?

Sorry, she has you over a barrel.

Try to negotiate with her.

Offer to split the profit with her.

Legally, it is her car.

Yea, if the car is in her name then there is nothing you can do. Drop the payment on her and maybe she will reconsider. Good luck.

If you stop making the payment then it would likely fall on her... I am assuming she was a co-signer on the loan in this deal?
Otherwise the vehicle will eventually be repossessed for non-payment.

No, you can not sue her for the 10k.
