Lingerie Maid Service, New Business Question...???

Hi, I just moved to california and am opening a Lingerie Maid Service. Heres what I need to know... I have many woman interested in the position, I want to put them on the website then promote the page for them to receive business. I need to know if I should have a contract for them to sign or how to go about it legally saying that these woman are basically Self-Employed and are accepting evey job we find under their own will and if something were to ever happen that I am not responsible. Also I need it to state that I am just promoting for these woman and that there is a fee for it, website maintenance and promotion, and that is how I profit. How should I go about this, or how should I word it?

First of all, welcome to California!

Now; what is going to determine the nature and extent of liability is whether you want to be a promoter, or an advertising executive, or an employer, or an agency, or what? Because merely disclaiming that the maids are self-employed may appease the I.R.S. and be a help to you at tax time, but it will do no good to limit your liability. Because by saying that you are "opening a lingerie maid service" you have already announced to the world that you understand and have assumed and accepted all liabilities; be it directly or vicariously.

And of course you should have some sort of writing (contract/agreement) between you and the women who would be doing the maid-work, but by the same token, the type of writing and the words used in those writings are going to determine whether you will be on the hook and in the dock should the proverbial ever hit the fan! And if Murphy's Laws are anything to go by, then you can be sure that it will hit the fan sooner or later.

Because if you are going to be promoting the maid services on your own website and derive an income from the services provided by the maids directly or indirectly through and or by residual, commissions, finders' fees, kick-backs, back-hander, under-the-table, or by any other method one would care to call it, then you are and will be held vicariously responsible for the maids' tortuous acts and liable to the would-be plaintiff for any damages regardless of whether they are payroll employees or 1099 independents.

But if you are going to be merely providing an advertising vehicle, similar to Yellow Pages® where your involvement in the matter would start and end with the insertion of the ads for pre-determined and one-time payments, then you would have no worries and no sleepless nights.

So give it some thoughts!

Once again, Jay neglected to mention the "services" his "maids" would be performing. Ever since the first place he posted this, where his post was removed as being inappropriate, he's tried to get away without listing them. But there's a very unpleasant name for people who promote what Jay is looking to promote. He's trying to claim it's a legitimate business. Not in this country, it isn't.

Oh, and btw, Jay, if you check my post count you'll see that I was on all three boards where I've seen you long before you were, and I'm on at least two more. So if you really want to post your question without my input, look for a board where I am not.

And Jay? Get a lawyer. You're going to need one.

I did just hire a lawyer who is writing the contract for me. And the services are listed on the site, By no means is this business illegal in anyway. Plus the business is not even open yet. Until I figure everything out which is what im trying to do it will not open. I dont understand why you are being so harsh?
 
We all know how practical it is to dust, vacuum, and scrub floors in 6 inch stilettos and a teddy. Just be careful with the bleach right?

Something tells me that they'll be on the floor, but it won't be very clean at all. My trouble with this is how are you going to convince call girl quality beauty to work for maid quality wages, or how are you going to convince prospective clients that a maid service is worth three times the going rate because you "can look, but not touch."

I think most men of money would rather go to a strip club...or skip the middle man altogether and go straight for the escort. It sounds like you want to limit your liability not from chemical spills or the accidental dish breakage, but if your girls decide to go above and beyond the call of duty and polish more than a doorknob.

My advice would be to take your maid service and turn it in to a car wash business. Then everyone is in public, the girls have excuses to be scantily clad, and you are providing a service that won't get you in to any trouble.
