Yes my wife is trying to sell her Homestead which is titled only in her name,but their is a abstract of judgement filed lien against me on the property. the title company says they will issue title insurance only if this person signs a partial release! This persons attorney says they won't sign until agree to pay lien. Title company says he has to sign has no choice. the contract to sell is in my wifes name and my name is no where on any deed or title.Where can we get a title insurance company to accept a homestead affadavit, where we wouldn't have to get this guy to sign and wouldn't hold up the sale of the property
