I would like to know if BYOB venues are responsible for DWIS in the same respect as bars that sell alcohol.
 
It is possible, even in a BYOB situation, that a social host could be liable for the acts of intoxicated guests if the host should have recognized the extent of the guest's intoxication and failed to take appropriate action to prevent further intoxication.

So, no, BYOB venues may not be liable "in the same respect" as bars that sell alcohol because the injured party would have a much greater burden of proving the host's culpability in a BYOB setting.

But it could happen and, as always, nothing prevents the lawsuit from being served on the host. Lawsuits like that are expensive to defend and juries are sympathetic to victims of drunks and will find the money in anybody's pockets.

Word to the wise for social hosts. Keep an eye on your BYOB drinkers, take appropriate action if they get intoxicated and, for pete's sake, have homeowners or renters liability insurance in case you do get sued.
