Liability in auto accident

My 18 year old son was the driver in a one car accident,in which a passenger was seriously injured.the car is owned by his older brother and is carried on my auto insurance. Are the older brother and myself liable in this situation?

If he is on your insurance, you are liable in a way that your insurance company is going to wind up paying for this and this will affect your rates.
