Lender not exercising equal treatment

We recently had to let a multi-family investment property go into foreclosure because we were not able to collect sufficient rent to cover the mortgage.

Now the lender is coming after us for a deficiency judgement. Our property manager said that he believes that there is a New Hampshire law that prohibits them from not pursuing the same action for all others in the same situation, and he believes he knows of others for which they did not pursue a judgement.

Does anyone know if there is any validity to that?
 
I'd be surprised. It's up to the lender's discretion whether they want to pursue personal judgment against the mortgagor. They may not have pursued it in other cases, but that doesn't mean they are obliged to not pursue it against you.
