Landlord rights in DC

I have an issue with a tenant moving out before his lease was up. In trying to determine whether or not I can hold his deposit to help defer some of the costs it has come to my attention that DC requires me to have a business license to lease my home. I was unaware of this requirement. Does this mean I forfeit all rights to withold the deposit?

I notified my tenant at the beginning of July that I would be moving back into my condo at the end of his current lease, Sept, 30, 2008. He notified me two weeks later that he would be vacating the condo as of August 1. Due to the fact that I would be moving back into the unit as of Oct, I had no way to good faith try to get someone in there to cover the rent for two months, so i have had to move back in two months early and had to pay rent in both places for the month of August.

I only want to help defray some of that cost if it is legally binding to do so with my signed lease.
