I have temporary custody of my son. He now resides with me in TX. Mother is in FL and is currently doing a case plan through the state. Once I obtained custody- she left for KY. She has not been complacent with her case plan per the state. Can I file for sole custody in TX now or will I have to wait until her case plan is deemed uncompleted? I was dismissed at the last hearing where reunification was ordered. He is still under the jurisdiction of Florida but living in TX and we have monthly check-ins with CPS. I was told if she did not complete her case plan to the judges satisfaction then he would stay with me in TX once the 6 month period was up. My plan is to file for custody then; however, if I can file now- I would prefer to do so
 
If you file now, she would have the incentive to complete her case plan quickly and you'll have wasted your time and money.

I suggest you wait until the end of 6 months after non-compliance occurs and then file. Better chance of success.
