    Texas
    Assuming a negligent driver in Tx causes severe injury to another driver, 3 herniated discs in both neck and back, is the max settlement limited by the amount of insurance carried by the negligent driver? Will the insurance provider pay more in certain cases?

    The insurance pays the policy maximum.
    If she bought a $10,000 policy, but the victim has $100,000 in injuries, insurance pays the $10,000.
    You'd then have to sue the broke deadbeat for the difference.

    And/or look to one's own Underinsured Motorists Coverage if one has enough coverage.
