Harassment, Stalking, Misconduct is this harassment

after many months of harassment a girl decided to confront my daughter and hit her pull her hair then she took her things and threw them on the ground when my daughter came home and said what happened i went and confronted the girl she admitted hitting my daughter then i said if you touch my daughter again i will break your neck the police charge me with harassment for saying this was that harassment ? they also charged the girl with harassment for hitting my daughter how can both be the same charge ?

It depends on the definition of the crime in your state. If the statute says something like: "A person who makes threats of violence against another or actually commits acts of violence against another, is guilty of harassment" , then both conducts here fall under that definition.

In most states there is a provision prohibiting making threats of violence against another person, under which the words "... I will break your neck" probably fit.
