is this a way for illegal sites to try and hide their activities or is it for real?

if such a law doesn't exist, are there any penalties for websites handling software cracks?

Hilarious that it is absurd. Absolutely a hoax. The items aren't meant for viewing but just to take up bandwidth... that's a good one.
 
This is almost as funny as the notion that if you ask an undercover officer, "Are you a cop?", he has to answer truthfully.
