Interesting drone question

I'm a member of a another forum board (for a particular hobby) and someone posted that their small town (of 400 people and 2 cops) just got a drone. Here's a situation that got posed that I thought I run by everyone here. If you are doing something illegal in your home, and the front window was wide open (no blinds over it) other than the fact you are plumb stupid, it would be safe to assume that if a cop was driving by and saw that activity, they could would then have enough cause to take action. However, if you have a second story window, and your activities would not be visible to someone on the street, what would happen if this drone were flying by and spotted the activity? Would that be enough cause to take action?
 
The key phase here is "reasonable expectation of privacy". Whatever scenario you want to create, if a reasonable expectation of privacy exists then a warrant or exigent circumstances must exist for the information to be used against you.
