Premises Liability Indirect liability

Our community owns and maintains one lake. There is a second lake which is owned by the homeowners bordering the lake. The property lines reach to the center of this lake and there is no public access to this lake.

I have just learned that the new Board of Directors of our homeowner's association has contracted to have both lakes maintained.

I take issue with this since community funds are to be used for all and not to benefit only a few. Yet, my major concern is the creation of liability.

By paying for the maintenance does the Association assume liability for this lake should someone either drown or otherwise is injured even though it is not owned by the Association?
