Last month my boyfriend, who lives with me, was arrested for failure to registar (PC290). He said that they immediately grabbed him and handcuffed him upon his opening the door. They asked if he would talk to them and he told them not without an attorney. They then asked if they could search the house and he told them "no". He asked the officers if he could get some warmer clothes on before being taken away. They escorted him upstairs to the bedroom where he has his clothes. During that time, a few of the officers were walking around in the other rooms upstairs. They then took him downstairs and had him wait outside for approx. one hour. with a few of the officers, while two other officers went inside. I came home approx. 90 min. later. The front door was open a few inches and I thought I heard voices and went cautiously upstairs to investigate. While upstairs, I noticed that lights were on everywhere and things that would not normally be opened were opened (i.e.- closet doors, etc.). In the office was my boyfriend's laptop computer which was on. It showed that he was in a chatroom. I went back downstairs trying to find where the voices were coming from. I open the front door and two officers were outside. Upon seeing me, they quickly came inside and told me that I could not be inside (my own house which I own). I asked them why and they replied that the house was being secured and a search warrant obtained. I asked them why the search warrant, and they replied that by what they observed on the laptop upstairs (which was in the office), that they have probable cause to believe that there may be child pornography on it. They allowed me to stay in the house with them. I asked them several times to leave until they had a search warrant and they said, "we can not do that". While there, they went upstairs on a few occasions while I was downstairs. Is this legal? Can they go inside a house and look around without first having a legal search warrant? My boyfriend took them only into the one bedroom upstairs for his clothes and yet they obviously went into others. Also, can they stay in the house if I ask them to leave?
