illegal foreclosure?

My husband and I and another couple had been buiding spec houses.After sitting on 4 for 2 years we bought one and rented it out.We fell behind on the payments but had caught up [matter of fact the banker drove to my house to collect it.]After not recieving the renters check we contacted him.He informed us the bank sent him a letter to send the check directly to them and thats what he did.After that we didnt send in the next payment they foreclosed.The payrnent the renters paid was 200.00 shy of what was due.Since then they sold the house.We have to talk to a lawyer anyway because we lost all our spec home{different bank}and haven't had the money to file bankrupcy-I was wondering if they could foreclose since they were accepting partial payment
