Ill Parole hold

If a person in the state of Ill was out of prison on parole, and got arrested for a new charge, his parole agent then put a hold on him. The person made bail on the new charge. How long can the person be held in the county jail before going back to the prison?

This is probably best asked of his PO or lawyer.

If it's anything like the great State of New York a parole hold prohibits the person from getting out whether or not they posted bail on the new charge. Here they hold you until you go back to prison to serve out the violation time and whatever time they may get for the new charge.

It would be foolish to release them with the likelihood they would abscond from going back to serve their original sentence. The law usually provides credit for time served after the initial charge is released.

How long is hard to say.
The person is entitled to parole revocation hearing in most states. I suspect such is true for Illinois, too. Some parolees beat the rap and get released back on parole. Some get the axe and get remanded back into a penitentiary. It could take six weeks, six months, maybe even a year; it all depends if its Chicago, or Carlinville.
