Medical Malpractice I just found out the asst. dr; lied to me.

On June 30;2003 I was hit by a elevator door; hurting my right shoulder & my neck while I was at work. In Aug. 2003 my doctor ordered an MRI & then the following month (Sept) I went in to see my dr & get the results. But; instead of seeing him I saw his asst. & she went over the results with me. She stated that I had a sprained neck & full & particial tears of my rotator cuff; I had the rotator cuff repaired. But; for almost a year I kept having problems with my neck; so I was sent to a pain management specialist. He did some tests & looked over the "same" MRI's & results (from Aug 2003) & on June 24, 2004 at my appointment with him; he stated to me that "I do not have a sprained neck" that I have "5 bulging discs & nerve damage in my neck & upper back". For almost a year I just assumed that I had a sprained neck & rest & maybe taking iubrofen is all I needed. If I would of known I had something alot worse I would of never just did nothing. As soon as I knew about my rotator cuff I had it taken care of right away.
I asked the Dr "Why would the asst. tell me I just had a sprained neck"? He stated "She was not truthful with me"!!
The asst. knew I was on workers comp; she does IME's; BUT I chose to go to this dr's office; I was NOT sent there by the company doctor.
This is not right --- Is this a form of "negilence" on her part??

I live in the state of Pennsylvania; I was hurt on June 30; 2003 & had the MRI done in Aug. 2003; And the asst. gave me the results on Sept. 9, 2003. Is there something I can do??
I am having "trigger point injections" & I have trouble sleeping & I am in pain alot of the time. And I'm thinking this could be something I might have to live with.

It is impossible to make an evaluation without knowing all the details of the case. You might have a case for medical malpractice.

You should consult an attorney experienced in medical malpractice cases and discuss your case with him or her.
