if me and my boyfriend where to complete, sign, and record a declaration of our marriage with the County Clerk would we have to live together for it to be legalized or can we live in separate houses until we can move in together in less than five months

How old is he?

How old are you?

Both intended partners must be of the age of majority, 18 years old!!!

If one of you, or both of you aren't 18, your nuptial filing must wait!!!

Are you inquiring about what is known as "common law marriage"?

Here are the requirements for such a marriage:

If you are legally married, the state will not care if one of you chooses to live on the moon. Cohabitation is not required in order for a marriage to be valid. There are many reasons why spouses might not live in the same house.

To have a common law marriage in Texas, the couple must:
 Agree to be married,
 Live together in Texas as husband and wife, and
 Tell other people that they are married.

A couple that wishes to formalize a common law marriage can file a Declaration of Marriage.
To do this, the couple should get a form for filing a Declaration of Marriage, sign it, and file it with the County Clerk in the County where the couple resides.

OP you need to answer these questions!

We do need to know the answers to those questions. If you are legally married, then you can certainly live a part as noted by Elle.
