I-140 rejected. What are my options?

My I140 recently got rejected. The reason given was employer's ability to pay. I have been paid my H1B wage for the past few years except for this year because the firm was going through a loss. Becuase of this my I-140 was rejected. Before this my EAD and advance parole had been accepted. My H1 B visa is valid till 30th September 2008. This time when I entered the US the immigration officer stamped my advance parole instead of H-1 visa. Am I out of status because of I-140 rejection even though my H1B visa is still valid. What are my options now after the I-140 rejection. Can I appeal the decision?
 
There is still a chance to save it.............Get an immigration lawyer. I don't want to guarantee anything without full knowledge of the case. Get a lawyer for consultation ASAP> it would cost about 100$ to get advice from the lawyer.
 
Thanks alot. I contacted a lawyer and he asked for $1000 each for appealing both I-140 and I-485. That is $2000 in total. Did you meant to say $1000 or $100? If $100 then I am being ripped off!
