Never married to father, no custody for 11 years of child life, child has been living with and cared for full time by mom, recent custody case was settled with joint custody when again child has lived with & still lives with mom his entire life and only sees father one weekend a month. Can this be changed in California? If so, how? Nothing has changed for visitation with father, son lives with mom full time, father still owes $20K back child support and was giving joint custody.

Maybe...

How?

Hire an attorney and have her seek a hearing to change the custody order.

Bear in mind, whatever the pappy owes YOU for unpaid support has NOTHING to do with his visitation.

What's with the third person business? Are you talking about two other people who aren't you? Or are you one of the people to whom you are referring? If so, which one are you?

father still owes $20K back child support and was giving joint custody.

Child support arrears have nothing to do with custody and visitation. There are ways you can enforce the child support. CA has a child support enforcement agency.

CA Child Support Services

That agency can be contacted for assistance.

Bottom line, though, since a custody arrangement was "recently" adjudicated in court, it's unlikely that the court will revisit it unless there is substantial change in circumstances.

Joint custody doesn't always mean joint physical custody

So - nothing has changed with where the child lives. The child still lives with mom. Dad still has visitation. The only thing that changed is now there's joint custody? Joint physical or joint legal?

I don't see what the issue is if the only thing that changed is now joint custody.

Are you the mom? Have you talked to a lawyer? If you're not mom, why are you asking about this?

Can this be changed in California?

Yes.

If so, how?

Either by stipulation of the parents or by filing an appropriate motion and proving a change of circumstances that warrants a change in the custody/visitation arrangement.

Nothing has changed for visitation with father

Then on what basis do you think things ought to be changed, and what exactly do you want to change?

father still owes $20K back child support

Then take steps to enforce the support obligation.

nd was giving joint custody.

Huh? Also, are you referring to physical custody, legal custody or both?
