Asylum How can people legally claim asylum when they overstay their visas voluntarily?

I am aware of some people who live in the area who are not here legally for what I'm guessing is a long time. They have joked about how they overstayed their visas and got help from staff provided by politicians to fill out asylum seeker forms. Is their claim against the law? How about the staff of the politician if they don't have any good faith belief that these people are actually fleeing for their lives from political persecution? In some cases they don't ask, don't want to know, just fill out forms. None of this seems sincere or legal.
