HOA IN ULSTER CO , NY

Based in NY ( Ulster Co) .Own our townhouse. We got a fine for not moving our car during a snowstorm. Is the HOA allowed to do that? It mentions nowhere in the HOA rules about a fine. It does mention cars have to be moved to plow - but nowhere mentions a fine. We said that to the HOA and the answer we get back is that the snow policy does not talk about a fine, but the board has the right to levy fines in situations where they deem appropriate. We couldn't move our car due to surgery.

If you were fined, apparently your HOA levied such fine.

You received an answer.

If you desire to overturn the fine, you will have to take the matter to small claims court, if the HOA refuses to return your loot (or keeps hounding you to pay up forthwith).

How could we possibly know? We obviously haven't read your CC&Rs. All I can tell you is that HOAs typically reserve the right to impose fines for rule violations, and those fines typically turn into liens against the property if not paid.
 
does the HOA get fined by another entity if the roads aren't cleared? Such that they are passing that fine through to you?
