My mother was recently hit by a woman who was the sister of the other car's owner and the insured. The other party has now informed us that the insurance has lapsed and they are not covered. My mother was not carrying an uninsured motorist policy. The woman is offering minimal payments. No injuries, but $4500 in damage.
Q1: is there anyway to determine if the other party is insured? I am wondering if they may be hiding their insurance coverage.
Q2: Is small claims court the only viable option at this time?
