Hit by Drunk driver

My daughter and I were hit by a drunk driver in Feb 2006. My daughter was seriously hurt and is permanently disabled. I only hurt one foot that has kept me in and out of work since. We are trying to go after the last two bars he was served at. My lawyer is trying to say he doesn't think the bars have insurance, I have been told by two bar owners and an insurance man that in PA if you lose your insurance you lose your license. Both me and my daughter have settled with his insurance and are still waiting for my underinsured to come thru. Is our lawyer right, could these bars not carry insurance?

It's a longshot to go after the bars because they are not necessarily responsible, Especially the first bar if he did not leave there drunk. you have to prove they served him too much alcohol and knew he was drunk when he left.
