Ok I am a business owner in the trade show events promotions industry, so i send out an average of 200 to 300 a month sometimes more.... Well back in march of 06 i recieved a call from fed ex asking if i sent out a package. When I told them no i had not well they said need to do a police report and also needed me to verify that it was not someone in my company who sent the package... I said ok not a problem... Well my office is also my home so about 3 hours later there is a knock on my door when i answered it there was a woman holding this package and before anything was said to pairs of arms came from behind here and pulled out my door and immediately put me in hand cuffs... Well after my rights were read they escorted me back inside my house and interviewing me... I spoke with them and answered all there questions... See i had never been arrested or in trouble ever so as i was told later by an attorney never speak... well while talking to officer she informed that there was meth in the package approx 116 grams according to police report... Well i know nothing about... the police did search my home and put me under arrest for transfer of meth.. now when searching my home they found absolutely nothing at all no drugs no praphial and no packing materisals like use to ship that package... so clearly is not me.. also they grabbed my cell phone and at that moment my romantic partner sent me a text message... well officer started to reply with out me knowing or giving premission.. well my partner sent me a text saying he was gonna go take of the babies.... (babies are three cats we had together causee found at two weeks old and bottle feed them.) well cop tried getting him to come to where i was... but then all suddent they asked me what the babies are and the three little ones are?? well he said that he knows that was refer to the three oz of meth that are in the package.... well my calculation of 116 grams is approx 4 oz not 9... but still under arrest... well i fought all the way to trial... well of course prosicution wanted to text to be thrown out which judge granted him even though we could prove that they did do it with out my say and according cop only sent one text and i new that but the 5 or so before i was told anything about phone where sent by who if i was in cuffs and my cell was in the other room... proof was the actual texts still on my phone with date and time of sent and recieved... then when i testified i was not allowed to answer that i had never been arrested and had no priors.... also due to the fact of family importance to me my aunt about a year ago when she got laid off from work and was without for about year i asked to live in my home to get back on feet so she does live with me.... well when ever place came up with prosicution they refered to my home as my aunts house.... well when my aunt and myself took the stand and tried to correct the fact that the house was mine and not hers in anyway proscution objected and judge said sustined to relavence well the fact that they are painting a pic of someone who is 29 and says self employeed and lives at aunts truly is a meth head and uses his family well that is incorrect... well the jury deliberated for about two days and came back hung jury no verdict reached... well the judge tells them to go back and deliberate more and come back with a verdict... about four hours pass we are all called back to court for verdict and at that moment my attorney is informed that judge and prosicutor went and spoke with jury during deliberations to answer querstions about the trial... well immediately again and for fifth time during the trial my attorney motioned for a mistrial... again denied.... well they came back with a lessor charge of pocession of dangerous drug.... (now when arrested no drugs found or even a trace that i had used drugs, so how is it pocession) well my attorney informs could fight it but if you have nothing worry about could probation and be done with or chance serving 15 years for a crime you did not committ.... welll while trying to decide what to do next i follow court orders and go to a probation presentence report meeting where i am being asked to fill out papers that are talking about going to prison for 5 years... and probation not an option.... so of course gonna fight this but waht i want to know is is legal for judgbe to answer questions for jury during deliberation face to face and decisuss it with them with out my atttorney present??? and if it is what can i do to get this dealt with cause next week i am going for sentencing and yesterday found out i am going to prison for sure.... and i am innocent... and can do an appeal but i have to sit in prison why that is going on... that is not right or fare... because of judges action through the whole trial was unfair and prejudice against me..... i was guilty and still have to prove my innocents which with this judge i am not allowed casue that would the cop look bad... and he believed a cop oir evidence.... so please help with what i should do cause i can not go to prison for a crime i did not commit.... and added info the person who recieved the package from person shipping it said on the stand that she could say it was me she got the package from... so only person who saw who sent it said it was not me..... please help.....
