My girlfriend is here, and has been here in the U.S. for the last 4 months on a work visa. She'll be returning to Russia in the next 2 weeks or so in order to finish her last year of school. Now, when she goes back, will we have to file for a k-1 visa? Are we able to get married now, while she's on a work visa? Or will we still have to file for a k1 visa?

Green Card Marriage. CONT'D

This is a follow up to my last post a few minutes ago. Is the process for getting a marriage license to a nonimmigrant the same as with a U.S. citizen. I am a U.S. citizen by the way.

Here is a link to the Nonimmigrant Visa for a Fiancee (K-1) fact page from the U.S. Department of State.

It explains a whole host of circumstances and forms that you need to familiarize yourself with including the Petition for Alien Fiancée, Form I-129F, the I-864 and I-134, the Form I-485 Application to Register Permanent Residence or to Adjust Status, and others. This will probably give you a whole host of information. Congratulations and good luck!
