Last summer, my sister and her husband gave a huge amount of money to a builder (who supposedly was a friend of theirs), for options on a new home he was building. They live in Baltimore MD. However, no contract was ever signed. The friend/builder asked them to sign a contract several months afterward, but my sister refused to sign it and has since asked for her money back.
As I understand, real estate contracts need to be in writing in order to be binding. I believe that several laws were broken when this "deal" was made, which included a real estate agent on the builder side. Can a claim of "verbal contract" be made in this case by the builder? What claim does my sis need to make in order to get her money back? Thanks for your help.
