Fire in rental house... homeowner insurance threatening

We suffered a fire in our rental house... had to rescue sleeping kids from huge blaze. Admitted to fire investigator and homeowner insurance rep that I had smoked a cigarette about an hour before the fire started, and rec'd a letter requesting thatwe pay the $42,000 that the insurance co.paid to homeowners.

We did not have renter's insurance.

We went broke from the fire.

Can they sue us for negligence? Is our financial status (broke) relevant?
