Financial Advisor Misrepresentation?

What recourse would I have with a financial advisor, that come to find out, directed me to roll over an entire 401K into variable annuities that "sounded" quite solid at the time but that I am finding out are completely inappropriate for my wife and myself and our investment goals--he flat-out gave us bad information. Upon further research I understand that he netted approximately $50,000.00 by selling us this investment. I have checked (a little late, I know) with the Financial Industry Regulatory Authority and found a very similar complaint from another client that was settled in that clients favor. All I want is to get OUT of these annuities. Unfortunately there is a large surrender fee of about $35,000.00 during the first few years of the contract. HELP!!! :(
