Hi,

Let's say I want to write a screenplay (film script) about a true story similar to the films "Seabiscuit" or "Dreamer".

Also, let's say that there are two novels published in 1960, by two different authors, about the same story I want to write, does this mean that the story was in public domain for those two authors to write about the same true story?

If the story is not in public domain, who owns the copyright? The horse owner and what if the horse is dead, or both the owner and the horse?

Also, how could two books both be published on the same story in the same year, do they both own the copyright or have they written a book based on public domain and if they have, is this true with film rights to this story?
