Sex Crimes, Sex Offenders False Sexual Assault

My son in Colorado was arrested (with a gun to his head in front of his kids!) when he accidently touched a neighbor girl on the bottom while scooping up his infant daughter the girl was holding. He'd been asleep on the couch when he heard the baby cry. The girl went to her mom across the street and the mom came over and starting beating my son while he was holding the baby so hard she broke her hand.

After his third court date yesterday, his attorney said the mom's now claiming she caught my 8 year old grandson looking at porn on the computer--neglecting to say her own son is the one who brought up the site and was there; that my grandson put his penis in her younger daughter's mouth and that he learned all this from my son. Her son is obsessed with sexual matters, including picking up statues and looking under them to see if they've got anything down there. This was known before all this mess happened.

My son has never been arrested for anything, holds a good job, and loves his family. I'm gathering character-reference letters to send the court from people that have known his whole life from here in California. His wife had a daycare for a while there and at least one client said she'd totally vouch for my son, as will neighbors. They've lost their home, but are now, thankfully, out of that neighborhood.

The lawyer he's retained is supposed to be very good, but, of course, she wants to be paid more to 'keep the investigation going.' Her fee is $10,000, of which she's been paid more than half and his dad and I are selling stuff to come up with the rest.

My questions: Will character-reference letters help? Does the fact the police instead of detectives investigated the case hurt my son's case? Can I write the lawyer and tell her we're working as hard as we can to get her money placate her? Can a jury see through this crazy woman's B.S.?

My son and his family are devastated and the charges would be laughable (if you knew my son) if they weren't so serious. I just need a ray of hope if possible.

There's a new development. My son is in Colorado Springs and his work takes him to the AF bases there. Today he was denied entry because he's a 'sex offender'! Now, last time I looked, someone is innocent until proven guilty, so what gives? He can lose his job now! I'm so angry and feel so helpless. What can he do?
 
I agree with the Judge here but let me ask you this - is there something we might be missing here? Typically I don't find the police entering a home with their guns drawn to arrest a man who accidentally touched a woman's bottom or hear that the mother is beating up a man with such force she breaks her hand.

My first impression was wondering what the neighbor girl was doing over at your son's home and what is the relationship? Is this about the neighborhood children playing with each other and then subsequently a claim is made that the act above took place? What bothers me is that your son isn't accused of molesting the neighbor or her son. It's all about your grandson from what it seems and it just feels like I'm missing a big piece here.

I wish your son the very best and hope that all works out for him. I'm not sure what we can do to help. Understand that the outcome of this case is more about the evidence and credibility of the source (children) than it is about someone else writing a letter that, to their knowledge and not relevant to the case at hand, your son is an upstanding citizen. This is what I know: The mom, 'J', is from a - and I hate to use this term, but will - white trash family; was abused by her father as a child; is a tough-talking ex-gang member, always out to 'get' someone or 'make them pay', according to my son's mother-in-law, 'K'. My husband told me that when we were visiting at Christmas, he and my son, 'L', went to J's a few times to borrow tools to fix my grandson's little dirt-bike and each time, J would 'be all over' L.

One nite when they went to her house for supper, my daughter-in-law, 'T', was sneaking her burger into the microwave because it was a little under-cooked for her liking. J saw what she was doing, jerked the plate from T's hand, SLAMMED the microwave shut, took the burger and threw it back on the barbeque. Then she wouldn't speak to anyone for the rest of the evening. T was shocked and embarrassed, to say the least. (She'd told J and her husband, 'B', that she liked her hamburger well-done before this and didn't want to say it wasn't.)

Back in March, when it was becoming obvious that J's son, 'C', was obsessed with anything sexual, including possibly molesting his own 4 year old sister (he's between 9-11, I believe), K told L and T that there was something wrong with those people and to stay away from them. They didn't listen (they never do!). They all lived in a cul-de-sac and the kids were always spending the nite at each others' homes. L and T had just given a barbeque for everyone to celebrate their baby's first birthday the next day and that's why J's daughter, 'S', was spending the nite and sleeping on the floor near the couch where L, after several beers and up since 5:30 a.m., had fallen asleep. He heard his baby cry from a dead sleep, reached over to get her from S and accidently touched S's bottom. Period.

My personal opinion of J's reaction and force used is pent-up frustration, jealousy, and anger, as in 'hell hath no fury like a woman scorned' perhaps. B is frequently out of town due to his job. She has a hair-trigger temper, probably from abuse, etc.

Why the police acted as they did, I don't know; unless they're like the gung-ho idiots we've got in this town - a bunch of little guys with short-man syndrome. My dad, a former deputy sheriff, and the rest of the SO couldn't stand our PD because of this. "The policeman is your friend." Sadly, this isn't true so much anymore, is it?

According to L's atty., the police tape of S's deposition looked and sounded completely rehearsed.

What is the difference between sexual assault and molestation? I've also wondered about this.

I guess my last update didn't go through, but L was denied access to one of the AF bases where his crew was working because he's a 'sex-offender'. WTF!!! Isn't someone still innocent until proven guilty? Now he could lose his job on top of everything else? What gives?
 
Now that it's getting down to the wire, the lawyer is charging $300 per hour and telling my son he shouldn't go to trial as he'd been drinking and the jury might think he didn't know what he did. She's got him freaked out enough to maybe accept a plea (they've offered a couple, misdemeanor + probation) so he can get it over with and move home out of that hell-hole. She also told him the judge would, if convicted, throw the book at him. So what's to stop him even if a bargain is reached?

I'm so angry - sorry, but I certainly see how attorneys get their bad reputation as sharks - $10,000 would be life-changing money for me and she wants to drop him because she knows she's milked us for all we've got.
