False Advertisement, software company

A software company advertises having released one of their titles as Open Source software. The company did this for about 5 months from what I understand and after a bit of time canceled the project and pulled all of the source code off of the web-site as well as having pulled developers off the project. They have not updated the web-site to convey that the project has been ended and source code is no longer available on the site.
The community is rather unhappy with this turn of events.
The web site still herolds the company as some kind of hero of the open source community ... which is totally false. The open source community is very disappointed with them. I've left the name of the company and software out purposefully.

I would like to know what constitutes false advertisement. Supposedly although the software is sold in the United States it is a foreign company, will this change the situation significantly?

I wasn't sure where False advertisement fell so feel free to move this thread.
