In a periodic tenancy where there are multiple
Lodgers in landlords house, when a lodger fails to pay rent, must landlord evict through formal eviction proceedings or may he give written 3 day notice, as stipulated in ca civil code
For a single lodger in an owner occupied residence?

Be very careful using that lodger provision.

Its very hard to substantiate, and you can waste time chasing your tale.

It takes longer to go traditional eviction, and you must follow each step carefully, but it works.

If there is more than one person renting then you have tenants, not lodgers. You must proceed with the formal eviction process.
 
If there is confusion, the provision about a "single lodger" is a reference to the number of renters in the owner occupied home, not martial status or number of people on a room.
