ebay sent my debt to collections agency, then charged me criminally and is seeking restitution do i have to pay debt twice?

Between the collection agency and the restitution you shouldn't have to pay more than 100% of what you owe.

I suggest you pay the collection agency and get a receipt.

Then hope it's credited to any fines or restitution if ebay doesn't drop the charges.

You aren't going to win this on either count.
