I have a home with an easement that contains a county maintain pump station. I have inquired with the county about liability if a worker or any other person is injured or if the pump station were to fail, since the pump station is on my property. The attorney representing the county has told me in a letter that under the GA constitution regarding easements that the state cannot indemnify a private property owner of liability for any worker or issues related to the easement. I would like to know what recourse I have to include separating the property and turning this property over to the county?
