My brother is currently initiating procedures for adjustment of status after getting married to a US citizen.
3 months ago he decided to go listen to the car radio while drinking a beer, somebody called the cops and he got charged with DUI, open container and no driver's license. He never had a license before in the US, he also never had any other arrests or charges brought against him.
Just a couple weeks ago his lawer got him to plead guilty to the 1st offense DUI in exchange for the dismissal of all the other charges. He did and got sentence to the standard sentence package for DUI in the state (DWI/DUI school, community service and the fines). The toughest sentence for DUI here is only 90 days in jail.
My question is very simple, will the CIS be able to use the dismissed chages against him (not the DUI) when they receive his application for adjustment of status? I know they will count the DUI as a conviction but what about the other stuff that was dismissed?
