Criminal Trials, Hearings Does the charge need to fit the crime?

I am being charged with "encouraging" blah blah blah.... Will the DA have to prove that the way the crime was commited will encourage more of that same crime to be committed by other people? If the DA cannot prove that, will they be allowed to change the charge or are all charges dropped? I live in Oregon.
