Do I have a case?

Long story short, my husband and I went out for ice cream after dinner. Not even 1/2 way through the ice cream, my husband bit into something hard. Knowing it wasn't a normal part of his ice cream, he pulled the piece out of his mouth. What he found he had bit into was someone's broken acrylic fingernail. He was completely disgusted, as you can imagine. We went back to the store and complained, but the lady only acted as if this were a common occurrence and asked if he'd like another ice cream. She stated that they get containers from corporate with hairs in them all the time and acted as if nothing were wrong.

I personally think someone is to blame here and have yet to uncover whether or not it was a fingernail belonging to a local employee, or someone at the factory. Either way, this was disgusting and my husband, who is usually not bothered by things, was really troubled by the whole episode. Any advice? We aren't the type to sue, but would we have a case?

A: About what? You had no damages.
