dispute between 2 share holders of co.op. society

I have assumed responsibility of Chairman of Co_Op.Housing Society recently this is Society having ROW houses..
Outgoing Chairman had allowed one member to construct house without mandatory consent/concurrence of neighbor.The guy who was given permission by Society,carried out construction even though building plans were not approved by appropriate authority.To save construction cost,he gave slope of his terrace in such a way that now water from his terrace is being discharged in neighbors plot.Now plot owner refuses to clean the plot after monsoon until unauthorised construction is removed.It seems ex.chairman had intentionally created this problem to force plot owner to sell his plot.Though plot owner seems right,Is society legally bound to direct the other guy(one who carried out construction) to make necessary changes in his construction.?P.S. Application of plot owner is also on record(which was submitted prior to his neighbor).Does revision of house tax without proper passing of plan make any construction legal?
