Hello all,
Last night I was charged with a DIsorderly Conduct charge for being a victim of very small dispute between my brother and myself. Late at night around 4am my brother and I ended up getting into a heated debat about his son. Alchohol was involved and things turned quickl south and the next they I know I was being thrown to the floor and being choked (markings are still on my neck). My brother has a anger issue when drinkoing which I'm aware of however I never thought it was this bad. My wife in turn called the police over to remove him from the house (we were all drinking) and I offered to pay for hotel. After about 1 hour talking with the 3 police men I ended up being sited for a Disorderly Conduct and so did he. This incodent happened in my own home in my living room to which only my wife and friends seen.
We were all very polite and cooperated with the officers every which way. The only questionable content with 1 police officer was he pushed me out of the way grabbing my arm and I ask him not to touch me (in a polite manor not rude) and he did again just for no reason and I said with a more forcefull tone "I said not to touch me" Please keep in mind he had no reason to touch me nor did I give him a reason to act in that manor. I was stranind in a doorway to were my brother was sitting, if the officer wanted to get inside the door, all he had to do was ask me to move (officer was very rude from the beggining, the other 2 officers were very proffesional).
All-in-all by the end of the mishap my brother was escorted to a local hotel for the night and everything ended the best it could have with the best possible cooperation from both my borther and myself.
With that said, I plan on pleading not guilty to the charges as I feel as if this charge was not needed as even though I was part of the fight, I was the victim and requested the assistance of the police. Obviously, my brothers side of the story states that I started by grabbing him. So of course there are 2 sides to ever coin in most situtation.
My main question is will it be in my benifit to plead not guilty (I've never had to do anything like this before) and see were the DA takes this? The Disorderly conduct codes are very non-specific and can be issued for verbal yealling in the street so this makes me a little leary on my chances of overturning the citation.
