We are a small business that entered into an agreement with a cash register system company a couple of years ago. We gave a deposit of $3,500 to the company and have paid a monthly service fee of $300 since. The agreement does not have an "end" or termination date, only states that 30 days notice must be given to the company if we would like to cancel services. We found another system that we like and gave the company 30 days notice that we would terminate. We expected at least a portion of our deposit back, as it was stated on the agreement that it was a deposit. We are set to return the cash register system, but the company will not refund any part of the deposit. Nowhere in the agreement does it state that the deposit is non-refundable. We have not breached the contract in any way.
