I recently won a judgement in small claims court because the defendent didn't show. i have documentation from their local sheriff office that they were served. Now today I was notified that the defendent has appeal the judgement. I just want to know how does that work when they did not show for the orginal court date?
 
What state are you in?
Were they personally served, sub-served, served by publication, etc?
Is it an appeal, or a motion to vacate?
Did the court have proper jurisdiction?
 
Default judgments can be vacated for cause. You need to get the file and see what they are claiming and you will need to file an answer.
