Debit card monthly charge for non-use?

I live in Pennsylvania and I have a debit card from a survey company I do surveys for (instead of them writing a check, they post my "earnings" to a debit card). The company is located in Pittsburgh, PA. I checked my balance today and notice I was charged a $3.00 "account maintenance fee". Is it legal in Pennsylvania to be able to charge this fee?

The terms and conditions state:

1. Account Maintenance Fee: Subject to applicable law, a fee will be applied to all accounts after the six month anniversary date, but will be waived if the following criteria are met: 1) It has been less than six months since the account was created; 2) There have been funds added to your account in last three months; 3) There have been purchases made with your account in last three months. The charge will be recurring each month unless the account is active as stated in (2) and (3) above or the balance of the account is $0.00.
