I purchased a car, and the finance company paid for the car. I did not pick up the car for months because of health issues.
The ownership transfer was not done. The car dealer has used the car running some 2000 km, even have traffic notices, The dealer even sent a statutory declaration saying that they are the registered owner and incorrectly name me as the driver, AS I could lose my licence to pay more than $5000
I have sent a statutory declaration and is asking the car dealer to refund me.
Because they have used the car after payment, I wish to know if this is a breach of the dales contract, and what are my rights.
I want to ask the car dealer to also refund me of the amount paid for the car ie to cancel the sales, as the car is devaluated etc . Thanks
