Employee left electrical tools in bed of work truck that was in a sheltered location at the end of the day. Next morning at begin of business day the work truck was driven to the assigned work site. Said employee did not report to work until 10:00 am next morning. While truck was at assigned work site it rained and employees tools battery powered tools were damaged. Employee claims he was told by company owner that the tools would be safe in the bed of the work truck and were in the company's care when they were damaged. Employee claims company is responsible to reimburse him for tools. If indeed, the owner told the employee the tools were safe, it would have been under the assumption that the employee was reporting to work the following morning at normal start time. Employee knew he would not be into work until late but did not inform the company owner of this until 7:30 on day of tardiness. Is the company liable for damages to the employees tools?

No, the company is not liable for the employee leaving his tools in the rain. The owner is not responsible for the weather.
