court ordered exention of hospital stay

What are the laws on paying psychiatric hospital charges when a self-admitted person wanted to be released at 7 days-the maximum insurance allowed, and the hospital got a court order and held him for an additional 3 days against his wishes? Insurance didn't pay for this, and we were told it would be written off. This was in 2000, now 5 years later we received a bill from a collection agency that bought the hospitals old accounts, everything else was paid for, but they want an additional $2800.00 for the 3 days extra they held him. Can I fight this? Any advice would be appreciated.

In the future, posting in the correct forum will get your questions answered more quickly. Regarding your question, since we don't know the facts, it is almost impossible to answer. It seems that this person had to be hospitalized, regardles of whether he/she wanted to. One might compare that situation to a patient who has just undergone heart surgery who says that he wants to be released before the day is over since he doesn't want to pay for an extra night's stay. Whether the full cost is justified is another issue since that seems rather exorbitant just for a hospital stay. You may want to raise these issues with the colleciton agency and see whether you can settle on a minimal amount. It might be time and cost efficient negotiating them down that way.
