Corporate Law copying concept of franchise

I have always wanted to open my own store. I recently came upon a franchise that I fell in love with . However, after looking at all the royalty fees they charge i have decide to open a store with the same concept. Would it be legal to copy the concept? This is in Texas.

If all you are copying is a concept, you are free to do so. However, be careful to insure that you DON'T copy anything that is protected. Obviously there are things like trademarks and copyrights. Copyrights not only may cover things like menus, operational manuals and photos, but may even cover the architectural design of the restaurant. You should probably discuss your specific plans with your attorney before you get too far along to make certain that there are no hidden traps.
