Here is the situation.
This guy is telling me that he was charged with 4 felonies (sexual assault, assault, etc.) 13 years ago and pled out to a misdemeanor assault after a drunken night at the bar. This guy was never indited and is telling me that the DA & cops were 'out to get him' on trumped up charges because he was a politician at the time. The DA and one of the police officers were also married when all this was going on, hence the 'both in on it together'. I seem to think that someone may have lied to the police about what happened or otherwise gotten the facts screwed up opposed to the conspericy theory, but who knows.
My question is, what sort of consequences can a DA and state or local police face if they intentionally and wrongfully charge someone? Don't they have to be able to show some sort of reason or evidence for charging someone before they do? Is this an ethics issue? Does someone that has been wrongfully charged have any recourse for something like this?
