Condo Water Damage

I own a vacation condo at a small ski resort in Utah. The condo next to mine had a leak, possibly due to frozen pipes. It damaged my unit, and the two below it. I contacted both my homeowners and HOA insurance companies and filed claims. The owner of the leaky unit is the resort, and they do not have homeowners insurance on that unit. Because this was a result of something that occurred in that unit, who is responsible? Does it matter if it was a frozen pipe or something else that broke? They refused to work with me directly stating that would imply negligence.
